Felony Case Dismissed At Trial

Client was charged with felony perjury for inadvertently omitting immaterial information on an application for a Public Defender. At the original hearing, our client attempted to clarify the omitted information, however the judge refused to allow her to speak and she was later charged with perjury. Despite never utilizing the services of the Public Defender, the County Attorney was relentless in prosecuting our client. On the morning of trial, Attorney Michelle Brekken argued for a dismissal by the Court in the interests of justice – an extremely rare form of relief under Minnesota Statute. The judge ultimately agreed that it was not reasonable to force my client to stand trial and as a result dismissed the case.
